McDonald & Barnhill, PA a is boutique litigation firm specializing in the representation of policyholders in property damage claims. The firm’s attorneys, Andy McDonald and David Barnhill, have devoted their careers to this cause. We do not represent insurance companies or their agents. We represent homeowners, boat owners, business owners, condominium associations, and other insureds. Our firm is located in Tampa, Florida. We handle cases throughout Florida and have tried cases in all parts of the State. We are actively involved in current issues surrounding insurance law and are periodically engaged for public speaking on topics related to the adjustment of property insurance claims.

We assist our clients in all stages of their claims. We work with public adjusters and contractors during the initial claim adjustment. We provide representation for examinations under oath and other conditions imposed by insurance companies. If a valid claim is denied or underpaid, we aggressively and systematically pursue the unpaid insurance benefits through litigation or appraisal. And if an insurance company violates Florida Statutes regarding claims handling actions, we will file a Civil Remedy Notice and engage a bad faith lawsuit where permitted.

We undertake representation on a contingency basis. We do not recover attorney fees or litigation costs unless there is a favorable resolution to the claim. In most instances, the insurance company is obligated to pay legal fees and costs after the claim is successfully resolved through litigation.
